DECISION DELIVERED BY SHARYN VINCENT AND ORDER OF THE TRIBUNAL
INTRODUCTION
1In 2018, the Tribunal, then constituted as the Local Planning Appeal Tribunal, allowed the appeals in part brought by Leslie Mews Inc against Council’s refusal of applications to amend the official plan and zoning by-law in order to permit a proposed infill townhouse development on lands known municipally as 387R-395 and 413 Leslie Street.(Decision PL160616)
2The proposal was revised on a number of occasions prior to the commencement of the 2018 hearing in attempts to address concerns arising from the circulation of the iterations. The hearing of merit proceeded on the basis of a total of ten (10) units: six (6) detached, and two (2) pair of semis, organized on and accessed by a private laneway. The Tribunal allowed the appeals and approved the official plan and zoning by-law amendments to implement the ten (10) unit concept, withholding the final Order until the instruments in final form were submitted to the Tribunal.
3The failure of Council to decide on the related application for site plan approval was referred to the Tribunal late 2020, and recently, the Parties have advised that they have had constructive discussions, scoping the light between them and moving towards the potential of settlement.
4At the joint request of Counsel, a further Conference Management Call (“CMC”) was scheduled, allowing time for the discussions to come to fruition, at which time either a settlement will be heard, or a hearing on the merit will be scheduled.
ORDER
5A further CMC has been scheduled for Monday, June 20, at 10 a.m.
