MEMORANDUM OF ORAL DECISION DELIVERED BY M.A. SILLS ON DECEMBER 8, 2022 AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) in the matter of appeals by Trolleybus URBAN Development; 955-969 Weston Road Development Limited Partnership; CP REIT Ontario Properties Limited; KingSett Capital; and Hollis Dev LP from the adoption by the City of Toronto of Official Plan Amendment No. 571 (“OPA 571”).
2The Affidavit of Service of notice of this CMC was received by the Tribunal and is marked Exhibit 1.
3The purpose and effect of OPA 571 is to add a new Secondary Plan, the Mount Dennis Secondary Plan (“MDSP”), to the Official Plan. The MDSP provides a comprehensive planning framework for future growth, development and community improvements in Mount Dennis.
4The MDSP lands are generally bound by the Humber River, Clouston Avenue, the CN rail line, Trethewey Drive, Keelesdale Park, Humber Boulevard, Rockcliffe Boulevard, Lambton Avenue, Jane Street and Eglington Avenue West.
5The Tribunal received a Participant Status Request Form on behalf of the Learning Enrichment Foundation (“LEF”) in advance of this CMC. The LEF owns the lands municipally known as 1240 – 1250 Weston Road, and on which it is proposing a mixed-use, multi-unit development. Without objection, Participant status was granted.
6Mr. Crawford advised the Tribunal that although he has not had an opportunity to canvass this with the Appellant parties to this point, it is his opinion that this is a case that could greatly benefit from Tribunal-led mediation services. Counsel to all Appellants confirmed their concurrence. Accordingly, Mr. Crawford will proceed to formalize the request for mediation services to the Case Coordinator having carriage of this file.
7At the request of, and with the concurrence of all parties, a second CMC has been scheduled on Monday, June 26, 2023 at 10:00 a.m.
