MEMORANDUM OF ORAL DECISION DELIVERED BY K. R. ANDREWS ON November 10, 2022 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1This is the first Case Management Conference (“CMC”) respecting an appeal by the Applicant. The subject application concerns an Official Plan Amendment and Zoning By-law Amendment to permit the construction of a 13-storey hotel consisting of 154 suites and amenities typical of a hotel, including restaurant. The Appeal arises following the City’s failure to make a decision within the prescribed timelines.
Service of Notice of CMC
2There was no issue with service of the Notice of this CMC, and so no further notice is required. The Tribunal was in receipt of the Affidavit of Service, which was marked as Exhibit 1.
Requests for Status
3No one attend the CMC seeking either party or participant status.
MEDIATION AND SETTLEMENT
4The Tribunal explored the possibility of mediation and settlement with the parties. The parties both confirmed that the prosects for settlement are very good and might be achievable by the time the Tribunal reconvenes for a second CMC in March 2023. Counsel for the City confirmed that he cannot entertain settlement until he receives instructions from his client, which he expects before the end of February 2023. The Tribunal therefore finds it prudent to schedule a second CMC in March 2023, which may be converted into a settlement hearing.
PROCEDURAL ORDER AND ISSUES LIST
5Similar to the timing for instructions from the City regarding settlement, counsel for the City confirmed that he cannot confirm his client’s position regarding the contents of a draft Procedural Order and Issues List until he receives instructions around the end of February. The Tribunal therefore finds it prudent to deal with the draft Procedural Order and Issues List at the March 2023 CMC. The Tribunal made it clear to the parties that a draft Procedural Order and Issues List must be filed with the Tribunal before the next CMC.
