MEMORANDUM OF ORAL DECISION DELIVERED BY M.A. SILLS ON SEPTEMBER 13, 2022, AND ORDER OF THE TRIBUNAL
1This was the first Case Management Conference (“CMC”) in the matter of appeals by Keep Vaughan Green and Hatem Abou El-Nile (the “Appellants”) from the adoption of an amendment to the Official Plan (“OPA 74”) by the Regional Municipality of York (“Region”), and the passing of Zoning By-law Amendment No. 035-2022 (“ZBA 035-2022”) by the City of Vaughan (“City”) pertaining to the properties owned by Clubhouse Developments Inc. (the “Applicant”), and known municipally as 20 Lloyd Street, 241 Wycliffe Avenue, and 737 & 757 Clarence Street in the City of Vaughan (collectively, the “subject lands”/ “property”).
2The Region has confirmed that it will it not be participating in the appeal proceedings.
3The subject lands are approximately 118 hectares (“ha”) in size and currently comprise the Board of Trade Golf Course, portions of the Humber River Valley System, and three single-detached dwellings.
4The Applicant is proposing to re-develop the subject property with a residential subdivision consisting of 526 single-detached dwellings and 136 townhouse dwelling lots, open space blocks, parks, roads, and infrastructure facilities.
5The purpose of OPA 74 is to expand the Woodbridge Centre Secondary Plan to include additional portions of the subject property and redesignating the subject properties from “Private Open Space” to “Low Rise Residential”, “Infrastructure and Utilities”, “Parks” and “Natural Areas”; to permit less than a 10 metre (“m”) vegetation protection zone where approved by the Toronto and Region Conservation Authority; and to specify the requirements for a tree preservation and tree canopy cover replacement plan.
6The purpose and effect of ZBA 035-2022 is to rezone the subject lands from “OS1” Open Space Conservation Zone, “OS2” Open Space Park Zone, and “R1” Residential Zone to “RD3” Residential Detached Zone Three; and “RT1” Residential Townhouse Zone, “OS1” Open Space Conservation Zone and “OS2” Open Space Park Zone, with site specific development standards and to permit a range of outdoor recreational uses, parks and trails in the Open Space Zone.
7The Tribunal did not receive any requests for Participant Status Requests Forms in advance of the CMC. However, there were two oral requests for Participant status at the hearing. The individuals making these requests were directed to complete and submit to the Tribunal a completed Participant Status Request Form by no later than September 20, 2022. To date, the Tribunal has not received the required form(s). As well, a letter dated September 22, 2022, was submitted to the Tribunal by Mario DiNardo on behalf of the Greater Woodbridge Rate Payers Association, wherein he details the collective concerns of the membership.
8Ms. Lampert informed the Tribunal that the Applicant will be pursuing a Motion to Dismiss the Appeal of Hatem Abou El-Nile.
9The parties have prepared a Draft Procedural Order (“DPO”). Once the parties have finalized the DPO it is to be submitted to the Tribunal for review an approval.
10In the event another CMC is required, or otherwise, to schedule a date for the hearing on the merits, counsel to the Applicant is directed to contact the Case Coordinator having carriage of this file.

The Conservation Review Board, the Environmental Review Tribunal, the Local Planning Appeal Tribunal and the Mining and Lands Tribunal are amalgamated and continued as the Ontario Land Tribunal (“Tribunal”). Any reference to the preceding tribunals or the former Ontario Municipal Board is deemed to be a reference to the Tribunal.
