MEMORANDUM OF ORAL DECISION DELIVERED BY R.G.M. MAKUCH ON SEPTEMBER 3, 2021 AND ORDER OF THE TRIBUNAL
1This is the seventh Case Management Conference (CMC) in this matter scheduled to address:
a) All of the disclosures directed to be provided by the Tribunal in its decisions dated November 5 and December 22, 2020;
b) Final Procedural Order (“PO”);
c) Respondent’s expert reports and proposed testimony;
d) Advise whether Tribunal assisted mediation will be requested;
e) The parties’ witness lists; and
f) Suggested dates and length of the hearing.
2Counsel advised that they have continued their discussions including the necessary disclosures, the exchange of reports as well as witness lists. They have also indicated that they would be jointly seeking to participate in Tribunal assisted mediation and would be making that request forthwith. That request should be made in writing, to Sandra Chan, OLT Strategic Resolutions Advisor.
3Counsel have also advised that any hearing would require at most two days.
4The Tribunal will not at this time schedule another CMC or a hearing date given the steps that are still required to be carried out to move this matter forward. The Tribunal does however direct the parties to provide it with a report in writing not later than Friday, December 3, 2021 as to the progress made towards the settlement of this matter or in the alternative, to provide a draft PO, which will govern the proceeding.
