1Further to this Tribunal’s Member Decision issued July 30, 2020, the Tribunal held a telephone conference call (“TCC”) on July 30, 2021.
2The purpose of the TCC was to determine the status of its procedural order respecting the Parties’ production of their documents on September 15, 2020 and the conduct of the Parties Examination for Discovery on October 15, 2020 and to determine if the Parties were in a position to proceed to a hearing.
3The Tribunal had set an earlier TCC on May 7, 2021. Mr. Sydor attended that hearing. Mr. Shulgan did not attend despite being so notified.
4Mr. Shulgan also did not attend this July 30, 2021 TCC despite being so notified. Mr. Sydor did attend.
5The Tribunal had no choice but to adjourn the hearing and return the file to the Tribunal’s Case Coordinator who have carriage of this case.
6In both instances, Mr. Shulgan apologized for his failure to participate indicating that it will not happen again.
7This Tribunal Member refers the matter back to the Tribunal in order to provide the Case Coordinator with direction in how the matter is to proceed further and to so advise the Parties.
8This Member is not seized.
