1This hearing was scheduled to deal with the Claimant’s Motion to Compel Compliance with the Tribunal’s Procedural Order issued on March 3, 2021, and to address possible amendments to certain timelines within it.
2At the opening of the motion hearing, the Tribunal was advised that the Parties have agreed to proceed to a private mediation.
3Both Counsel accordingly asked the Tribunal to stay the motion hearing and the possible amendments to the Procedural Order until sometime after December 13, 2021.
4A tentative, but not yet confirmed date of December 6, 2021, for the mediation, has been agreed upon.
5Mr. Rayman advised that he has no instructions to withdraw the intended motion and Ms. Blanchard asked the Tribunal to reschedule this matter a week after the mediation is held if it is unsuccessful in reaching a settlement.
ORDER
6The current Procedural Order remains in place and suspends its timelines.
7The Claimant’s Notice of Motion dated June 16, 2021, on consent be held in abeyance.
8The Parties are to schedule a further telephone conference with the Tribunal’s Case Coordinator, Jason Kwan at an agreed upon time after the week of December 13, 2021.
9Should the proposed mediation be successful, the Parties are to contact the Case Coordinator and request that the Tribunal Case No. LC200032 be closed.
10Until then, the 15-day hearing scheduled that is to begin on May 2, 2022, remains on the Tribunal’s calendar.
11This member will not be seized for any further procedural matters or the hearing.
