MEMORANDUM OF ORAL DECISION DELIVERED BY DAVID L. LANTHIER ON JUNE 4 and JUNE 22, 2021 AND ORDER OF THE TRIBUNAL
1The Case Management Conference (“CMC”) addressed in this Decision and Order is expected to be the final case management hearing event preceding the commencement of the hearing of these Appeals on August 9, 2021.
2The CMC for June 22, 2021 was scheduled following the CMC held on May 11, 2021, and the Decision and Order issued on May 26, 2021, with the expectation that the Tribunal would receive the final draft of the calendar-projected work plan and attend to the few remaining matters.
3However, prior to this date, the parties jointly requested an interim telephone conference call to address further scheduling matters necessary to permit the completion of that draft work plan. This Decision and Order now addresses the additional directions and orders provided on June 4 and June 22, 2021.
ADDITIONAL HEARING TIME – TECHNICAL DISCIPLINE EVIDENCE
4The parties, through ongoing discussions, tentatively proposed to hive off the technical discipline evidence and issues in the specific areas of geomorphology, geotechnology, hydrology, hydrogeology, stormwater management, aquatic biology and natural heritage, and deal with them separately within an additional five-week hearing period to be scheduled in 2022. This division of the evidence would then allow the parties to devise a workplan that would permit a four-day hearing week, taking into account the two weeks that the Tribunal would stand down from August 16 to August 27, 2021. The parties accordingly requested an additional opportunity to speak to this Panel Member on June 4, 2021, at which time the proposed segmenting of the evidence and issues into these two blocks of hearing time was endorsed by the Tribunal.
5Following the conclusion of the first block of hearing time from August 9 to December 23, 2021, and the closing submissions scheduled for January 12, 13 and 14, 2022, the Tribunal has now set aside five weeks of hearing time commencing June 1, 2022, tentatively to continue as a virtual hearing.
6The connection coordinates for this additional five-week period will be provided at a later date. Based on the information from the parties, it is possible that they may eventually be able to resolve all or some of the technical evidence issues such that all or part of the additional five weeks of hearing time may be released from the Tribunal’s calendar.
7The parties will, by mutual arrangement, re-set dates for the exchange of witness statements for the technical discipline evidence from what was previously agreed-upon and provided for in paragraphs 14 and 16 of the Procedural Order, and paragraphs 22 and 23 of the Decision and Order of May 26, 2021. This will be addressed with the Hearing Panel in the course of the hearing.
HEARING PLAN
8The draft hearing work plan directed in paragraph 18 and 19 of the prior Decision and Order, is now based upon a four-day per week format for the period from August 9, 2021 to December 17, 2021 and has been provided and reviewed by the Tribunal. Subject to such further directions as the Hearing Panel may provide, the hearing of these Appeals will now be governed by the Draft Hearing Plan attached to this Decision as Attachment 1.
9The Hearing Panel will additionally be available to sit on Friday, August 13, 2021, if determined to be necessary, and all counsel and witnesses should ensure that they remain available for this possibility.
OTHER DIRECTIONS
10The following additional directions were provided by the Tribunal, all of them subject to the overriding discretion of the presiding Hearing Panel:
(a) Those individual days already removed from the scheduled hearing time pursuant to the prior directives of the Tribunal will determine the remaining four days that the Panel will sit in those weeks. Otherwise, the expectation is that the Tribunal and the hearing will stand-down on the Friday of each week;
(b) It is tentatively expected that a three-member Panel will preside over these Appeals.
(c) Hard copies of the Joint Document Book(s) and the compendium of witness statements, Curriculum Vitae(s) and Acknowledgements of Expert’s Duty are not required by the Tribunal. Instead, the parties will cooperate to provide one USB key for each of the three Panel Members containing the Joint Document Book and one additional USB key for each Member containing the compendium of witness statement materials. In addition, the Case Coordinator will be provided with one additional USB key of each of the two document collections.
(d) All PDF documents are to be tabulated and paginated with bookmarks and tables of content. Any site plans, surveys, sketches, or other technical documents, particularly those containing fine print, are to be provided is scaleable PDF format for easy enlargement.
(e) The USB keys are to be delivered to the Tribunal not later than July 21, 2021 in order to permit distribution to the Panel Members.
(f) The Tribunal has been advised that opening submissions will be delivered on the first day of the hearing by ClubLink, the Town and the Region. HRCA and Fairway Hills will likely reserve their opening submissions to the start of their case.
(g) The parties have advised the Tribunal that they wish to use the services of a Verbatim Reporter for the purposes of providing an ongoing written transcript of the proceedings with the intention of distributing transcripts of each week’s proceedings on a weekly basis. This request is approved. Counsel for the Town, or a representative of the Verbatim Reporter is to contact the Tribunal’s Case Coordinator, Jason Kwan for the purposes of coordinating such recording services for the electronic hearing.
(h) In accordance with Rule 22.9 of the Tribunal’s Rules of Practice and Procedure (“Rules”) the Case Coordinator, on behalf of the Panel Members, will be provided with an electronic copy of the transcript, as provided by the Verbatim Reporter each week. The delivery of the transcripts to the Tribunal shall be concurrent with the delivery of the transcript to the parties and provided free of charge.
(i) Arrangements for the hearing of any Reply evidence by ClubLink, which is not currently provided for in the Draft Hearing Plan, will be determined by the Hearing Panel.
EXPERT WITNESS OBSERVERS
11For clarification, and in order to ensure that there is direct and uninterrupted observation of the evidence, all expert witnesses observing the hearing for the purposes of their respective retainers, may access the electronic hearing by logging directly into the GoToMeeting platform in accordance with paragraphs 10 to 12 of the Decision and Order of the Tribunal issued on May 26, 2021.
12All expert witnesses who are observing, and not testifying, are directed to turn off their cameras and mute their microphones before logging into the hearing each day.
13All other members of the public wishing to observe the conduct of the Hearing will access via the YouTube live-streaming as set out in paragraph 9 of that same Decision and Order.
RECORDING OF HEARING PROHIBITED
14Due to the extent of the public and media interest in these proceedings thus far, the Tribunal hereby confirms and orders that unless authorized by the Tribunal or the Hearing Panel pursuant to Rule 22.5 to 22.7 of the Tribunal’s Rules, the taking of, or attempting to take, a screenshot, photograph, motion picture, video or any other recording of any portion of the hearing of these Appeals, or the dissemination of any still shot or recording of any portion of these proceedings at any time, is strictly prohibited.
15Under s. 29 of the Statutory Powers Procedure Act, contravening this prohibition against recording constitutes an offence, subject to a fine of up to $25,000 on conviction.
OTHER MATTERS
16The Tribunal so orders and provides these CMC directives for the purposes of the case management of these Appeals.
17All directions and orders here, and previously, provided for the purposes of the case management of these Appeals are subject to the discretion of the Panel Members presiding over the hearing.
