THESE MATTERS having come on for public hearing, and the Tribunal in its decision issued on February 27, 2018 having allowed the appeal and approved the proposed amendments to Zoning By-law No. 438-86 in principle and withheld its final order to allow the parties to provide the final form of the zoning by-law amendment and to satisfy certain conditions contained in Attachment 1 to the Tribunal’s February 27, 2018 decision;
AND THE TRIBUNAL having been provided with (i) an affidavit sworn by Michelle Charkow in support of certain revisions to the proposed zoning by-law amendments, (ii) the final form of the zoning by-law amendments, and (iii) having been notified by the parties that the conditions to the issuance of the Tribunal’s final order have been satisfied;
THE TRIBUNAL ORDERS that the appeal is allowed, and Zoning By-law 438-86 is hereby amended in the manner set in Attachment 1 to this Order, and Zoning By-law 569-2013 is hereby amended in the manner set in Attachment 2 to this Order. The Tribunal authorizes the municipal clerk to assign a number to these by-laws for record keeping purposes.
