DECISION DELIVERED BY R.A. BECCAREA ON MAY 28, 2021 AND ORDER OF THE TRIBUNAL
INTRODUCTION
1The scheduled hearing before this Tribunal was by a motion for the Respondent to provide the answers to questions and produce relevant documents refused at the Examination for Discovery of Neville McAnuff on January 19, 2021 as listed in the Refusal Chart attached to the Motion material dated May 14, 2021.
2At the commencement of the motion hearing, Mr. Lavictoire, on behalf of the Claimant, asked that the Tribunal adjourn the motion sine die and if necessary, set another Case Management Conference ("CMC") to determine the matter.
3There have been previous Tribunal hearings; a CMC set for October 29, 2021 and a hearing date set for two weeks in January 2022.
THE HEARING
4Mr. Lavictoire indicated that within one month's time, he should be able to advise the Tribunal that the matter has been settled.
5Rather than releasing the dates of the scheduled CMC and Hearing, however, it was agreed to keep those dates for now, pending the advice by both Counsel in a month's time of the disposition of the Claim.
ORDER
6The Motion before this Tribunal is adjourned sine die.
7The Parties are to advise the Tribunal's Case Coordinator, one month hence, of the status of claim and possible settlement particulars and an intended Tribunal Order if deemed necessary.
8This Member is not seized.
