MEMORANDUM OF ORAL DECISION DELIVERED BY R.G.M. MAKUCH ON MAY 7, 2021 AND ORDER OF THE TRIBUNAL
1The purpose of this Case Management Conference (“CMC”) was to get an update from the parties as to what if any, progress has been made with respect to the finalization of this matter since the last CMC held on November 26, 2020.
2Counsel had advised the Tribunal at the November 26, 2020 CMC, that the City and Appellant were exploring various ways in which this matter could be resolved in order for the Tribunal to issue a final order.
3Counsel proposed to make a joint Motion for directions pursuant to s. 41(4.2) of the Planning Act (“Act”) to have the Tribunal determine whether matter referred to in paragraphs 1 or 2 of s. 4 is subject to site plan control. The Tribunal notes that the City of Toronto Act contains mirror provisions.
4The parties are hereby directed to bring this Motion and to file all materials with the Tribunal on or before Friday, July 30, 2021. The Motion will be disposed of in writing.
