THESE MATTERS having come on for a settlement hearing before the Ontario Land Tribunal, formerly known as the Ontario Municipal Board on June 27, 2017;
THE TRIBUNAL having considered the evidence of a qualified Land Use Planner and Urban Designer, Robert Glover, as well as the submissions of the Parties;
AND THE TRIBUNAL having been satisfied that the proposal represents good planning and having issued a Decision and Partial Order on July 19, 2017, and an amending Decision issued on September 21, 2017, allowing the appeal in part, with the final Order on the zoning by-law amendment withheld pending the satisfaction of certain conditions;
AND THE TRIBUNAL having received confirmation on consent from the successor in title in the subject property to the Applicant and from the City of Toronto that the conditions have been satisfied.
THE TRIBUNAL ORDERS that:
The final form of the zoning by-law amendment to the former City of Toronto Zoning By-law No. 438-86, as amended, attached hereto as "Attachment 1" is approved. The Tribunal authorizes the municipal clerk to assign a number to this by-law for record keeping purposes.
The Tribunal may be spoken to in the event that some matter should arise in connection with the implementation of this Order.
