THESE MATTERS having initially come on for public hearing before the Tribunal from April 19-23, 2021;
AND THE TRIBUNAL having issued its Decision and Interim Order on October 13, 2021, which allowed the appeals in part, authorising two provisional consents to be granted for properties located at 600 and 622 North Waseosa Lake Road;
AND THE TRIBUNAL also having allowed the appeal in part and Zoning By-law No.2008-66P is to be amended in-keeping with paragraphs 46 and 47 of the same Decision and Interim Order for properties located at 600 North Waseosa Lake Road, 100 Treasure Island and 200 Treasure Island;
AND THE TRIBUNAL having withheld its Order in respect of the appeal of the zoning by-law amendment application for the subject properties pending the provision of the final form of the instruments deemed suitable for issuance by the Town of Huntsville;
AND THE TRIBUNAL having been provided with final form of the aforementioned instruments;
NOW THEREFORE THE TRIBUNAL ORDERS, in accordance with the Decision, that:
a) the appeal is allowed, in part; and
b) Zoning By-law No.2008-66P, as amended, is hereby amended in the forms attached hereto, being Attachment A and Attachment B respectively.
