UPON READING the Affidavit of Matthew Coffey sworn the 9th day of December 2021 and the attachments thereto;
AND UPON CONFIRMING that the request to amend the Condition of Draft Subdivision Approval Number 17(a) in this matter approved by the Tribunal in its Decision/Order issued November 10, 2020 is made on consent of the parties;
THE TRIBUNAL ORDERS that Condition of Draft Subdivision Approval Number 17(a) in this matter approved by the Tribunal in its Decision/Order issued November 10, 2020 is hereby amended to read as follows: “This Draft Plan approval will lapse on November 25, 2025, unless extension is given by the County.”
AND THE TRIBUNAL ORDERS that no further amendments to the Conditions of Draft Approval are being made at this time and all other Conditions of Draft Approval remain in full force and effect;
AND THE TRIBUNAL ORDERS that pursuant to subsection 51(56.1) of the Planning Act, the County of Prince Edward shall have the authority to clear the Conditions of Draft Approval and to administer final approval of the plan of subdivision for the purposes of subsection 51(58) of the Planning Act.
In the event that there are any difficulties implementing any Conditions of Draft Plan Approval, or if any changes are required to be made to the draft plan, the Tribunal may be spoken to.
