THE TRIBUNAL having received a notice of appeal to the approval of the Town of New Tecumseth Official Plan by the county of Simcoe filed by Don Jerry and Terry Breedon dated September 7, 2021;
AND THE TRIBUNAL having undertaken the preliminary screening of the appeal, as per Rule 15.1 of the Tribunal’s Rules of Practice and Procedure;
AND THE TRIBUNAL having been informed that the Appellants did not make oral or written submissions to council;
AND THE TRIBUNAL having received a sworn declaration from the County of Simcoe indicating that the County does not have any correspondence on record from the Appellants indicating they made oral or written submissions to council with respect to the subject matter;
AND THE TRIBUNAL having issued a validity of appeal letter to the Appellant on December 8, 2021 providing them an opportunity to respond to the County’s position pursuant to section 17(46) of the Planning Act;
AND THE TRIBUNAL having been informed that the Appellants do not wish to challenge the County’s position;
THE TRIBUNAL HEREBY ORDERS that the appeal of the Town of New Tecumseth Official Plan by Don Jerry and Terry Breedon is dismissed pursuant to subsection 17(36) of the Planning Act; and
THE TRIBUNAL FURTHER ORDERS that the Town of New Tecumseth Official Plan, as approved, comes into effect on the day after the date of this Order, pursuant to s. 17(47) of the Planning Act.
