THE TRIBUNAL having received a Notice of Arbitration and Statement of claim filed by A and M Krajishnik (the Claimant) dated February 07, 2017 against Her Majesty the Queen in right of the Province of Ontario, as represented by the Minister of Transportation (the Respondent);
AND THE TRIBUNAL having scheduled a merit hearing for May 28, 2018 and mediation event for March 13, 2018; subsequently adjourning same to be replaced by Tribunal led-mediation;
AND THE TRIBUNAL having subsequently adjourned the hearing events at the request of the parties to allow for private mediation and settlement discussions;
AND THE TRIBUNAL having issued a letter requesting an update on December 31, 2019;
AND THE TRIBUNAL having been notified of the matter being settled and file to be closed on January 13, 2020;
THE TRIBUNAL HEREBY ORDERS that the Dismissal Order dated May 6, 2020 is rescinded except that the file will be closed pursuant to the advice and request of the Claimant on January 13, 2020, that the matter has now settled and the file should be closed.
