THE TRIBUNAL having received a notice of appeal filed by Greg Rea (“Appellant”) dated May 29th, 2021;

AND THE TRIBUNAL having undertaken the preliminary screening of the appeal, as per Rule 26.05 of the Tribunal’s Rules of Practice and Procedure and having determined that the appeal is not valid because the Appellant did not provide oral or written submissions to council in accordance with the legislative requirements set out in subsection 34(19) of the Planning Act;

AND THE TRIBUNAL having received a declaration from the Township of McKellar dated June 17th, 2021 affirming that the Clerk’s office does not have any correspondence on record from the Appellant related to the subject matter, and affirming that the Appellant did not make oral or written submissions at the Public Meeting held on November 4, 2019, with respect to the subject matter;

AND THE TRIBUNAL having issued a letter dated November 16th, 2021 to notify the Appellant of the result of the preliminary screening;

AND THE TRIBUNAL having provided the Appellant the opportunity to challenge the preliminary determination and having received a response on November 30th, 2021;

AND THE TRIBUNAL having reviewed the Appellant’s response and determining the response to be unsatisfactory;

THE TRIBUNAL HEREBY ORDERS that the appeal by Greg Rea is dismissed pursuant to subsection 34(19) of the Planning Act.
