AMENDING DECISION OF THE TRIBUNAL DELIVERED BY STEVEN COOKE
1In accordance with Rule 24.4 of the Tribunal’s Rules of Practice and Procedure, whereby the Tribunal may at any time and without prior notice to the parties correct a technical or typographical error made in a decision or order, the Decision and Order (“Decision”) issued on November 5, 2021, is hereby amended.
2By deleting paragraph [20] from the Decision:
20THE TRIBUNAL ORDERS that the appeals are allowed, and the variances to By-law 7625 set out in Attachment 1 to this Order are authorized subject to the condition that a monetary contribution of $52,000.00 be secured in a s. 45(9) Agreement.
3And replacing it with the following:
20Prior to the earlier of the issuance of Site Plan Approval or the issuance of any further building permits for the subject site, the owner shall make a cash contribution to the City of Toronto, in the amount of $52,000.00 to the satisfaction of the City Solicitor, to be allocated toward capital improvements in the vicinity of the subject site to the satisfaction of the Chief Planner in consultation with the Ward Councillor. The financial contribution shall be indexed upwardly in accordance with the Statistics Canada Non-Residential Construction Price Index for Toronto, calculated from the date of final approval of the minor variance application to the date of payment.
4In all other respects the Tribunal’s Decision remains the same.
