THESE MATTERS having been subject to a Case Management Conference on May 28, 2021;
AND THE TRIBUNAL on consent having granted participant status to David Amato, Meghan Payne, Sherry Pedersen, Sunnylea Kingsway Community Association (collectively the “Participants”) in these matters;
AND THE TRIBUNAL having conducted a mediation assessment and having approved the scheduling of a mediation to address the appeal of 2457938 Ontario Limited (“Appellant”), in connection with the properties municipally known as 3100-3200 Bloor St W & 4-8 Montgomery Road in the City of Toronto;
ACCORDINGLY, pursuant to its powers under the Ontario Land Tribunal Act, and Rule 18.3, the Participants in this proceeding are permitted to participate in this Tribunal-assisted mediation, and will have the rights and obligations of a party for the purpose of the mediation, which is set to begin on November 2, 2021.
THIS ORDER of the Tribunal does not apply to any contested litigation of the appeals in the event the appeals are not resolved through mediation nor shall this Order be relied upon by any party for any purpose in such event.
