DECISION OF THE BOARD
This is an application filed under section 96 of the Labour Relations Act, 1995, as amended (the “Act”) alleging a breach of section 74 of the Act.
The responding party submits that the application does not disclose a prima facie case.
The Rules provide in part:
- Any application filed with the Board must include the following details:
c) a detailed description of the orders or remedies requested;
d) a detailed statement of all the material facts on which the applicant relies, including the circumstances, what happened, when and where it happened, and the names of any persons said to have acted improperly;
The application does not contain a statement as to the orders or remedies requested.
Further, the application is not specific as to the circumstances of the complaint, what happened, were and when it happened and the names of any persons said to have acted improperly.
In the circumstances and in accordance with the Rules, this application is dismissed without prejudice to the applicant to file another application that fully sets out the information as set out in paragraphs 3, 4 and 5.
