This is an employer’s application for review of an Order to Pay dated May 25, 2001. Pursuant to section 68(3) of the Employment Standards Act (the “Act”), an application for review must be made 45 days after the date of the order. This application was filed outside of that period.
By letter dated July 18, 2001, the Board wrote to the applicant, indicating that the application appeared to be untimely, and inviting the applicant to seek an extension of time if it wished. The Board directed the applicant to make such a request within 10 days.
To date, no request for an extension of time has been received by the Board.
DISPOSITION
- This application is dismissed because it is untimely. There would appear to be no impediment to the Director, Employment Standards paying out to the employee the monies being held in trust.
