DECISION OF THE BOARD; October 5, 2001
1. At the hearing on October 5, 2001 a majority of the Board, Board Member Ronson dissenting, issued the following oral decision:
The Board has considered the submissions of the parties. The majority, Mr. Ronson dissenting, has decided to direct that the ballots cast in the applicant’s proposed bargaining unit be counted.
The Board anticipates that if the union is unsuccessful in its own bargaining unit, that will be the end of the matter. It would not be open to the applicant to change its position at that point. If the applicant is successful the hearing will continue on October 15.
The Board will advise Mr. Bowman of this decision and he will contact the parties to arrange a date for the count prior to October 15, 2001.
