DECISION OF THE BOARD; August 1, 2001

1This is an application brought pursuant to the Employment Standards Act, R.S.O. 1990, c.E-14, as amended, (the "Act") for review of an Order to Pay #47613.

2The employer Riello Canada Inc. and Ms. Schuneman reached a settlement of this matter.

3Pursuant to the terms of the settlement the employer withdrew its appeal and it was further agreed that all funds paid to the Director of Employment Practices in trust are to be disbursed to the employer.

4Having regard to the Minutes of Settlement, I hereby order that all funds paid to the Director of Employment Practices in trust are to be disbursed to the employer.

5The Ministry of Labour a responding party to this application but not a signatory to the Minutes of Settlement, shall have ten working days from the date of this decision to request, if necessary, that this matter be relisted for hearing.

DISPOSITION

6In the absence of a request described in paragraph 5, this matter shall be deemed to be terminated.
