3232-99-R Teamsters Local Union 938, Applicant v. Mackie Moving Systems Corporation, Responding Party v. Professional Personnel Ltd. and Adams Services, a division of 1083859 Ontario Limited, Intervenors.
BEFORE: Patrick Kelly, Vice-Chair.
DECISION OF THE BOARD; October 16, 2001
1By decision dated October 4, 2000, the Board adjourned the hearing of these applications sine die for a period not exceeding one year. On October 1, 2001, counsel for the applicant requested that these matters be re-listed for hearing. Counsel for the responding party resists that request, alleging unreasonable delay. The responding party submits that the applications be dismissed, or in the alternative, that the Board direct the applicant to explain the alleged delay.
2The applicant’s request was made within the period of time set out in the Board’s previous decision. The applicant is not obligated to explain the timing of its request.
3These matters are to be re-listed for hearing in the normal course in consultation with the parties.
4I am seized.
“Patrick Kelly”
for the Board
