DECISION OF THE BOARD; December 7, 2001
This is an application for consent of the Board to extend the trusteeship of Canadian Union of Public Employees Local 2519 (“Local 2519”) pursuant to section 89(2) of the Labour Relations Act, 1995, as amended (“the Act”). The applicant filed a Statement of Trusteeship dated January 29, 2001 with the Board on February 8, 2001. The Statement of Trusteeship conferred upon the applicant supervision or control over Local 2519 until December 13, 2001. This application for an extension of the trusteeship was filed with the Board on November 28, 2001.
The application discloses that, due to certain alleged events, no members of Local 2519 are willing at this time to serve on the executive of Local 2519. The application further discloses that copies of the application and attached notices (in French and English) to all members of Local 2519 - directing them to file any comments concerning the application with the Board - will be mailed to all the members.
Before considering this application further, the Board directs the applicant to provide a copy of this decision, and, to the extent it has not done so, copies of the application in English and French, and the notices it prepared in English and French to all the individuals in the bargaining unit affected by the trusteeship, so that the copies are received by those individuals on or before December 14, 2001. The applicant is further directed to confirm in writing with the Board, on or before December 17, 2001, that it has complied with the Board’s direction.
Any individual in the bargaining unit who wishes to make representations to the Board about any objection to this application, must file with the Board a detailed statement of representations setting out the reasons for the objection, and deliver it to the applicant, so that it is received by the Board and the applicant by no later than December 31, 2001, following which the Board will give further consideration to this application based upon the materials before it.
