1This is an application filed under section 96 of the Labour Relations Act, 1995, S.O. 1995, c.1, as amended (the "Act"),.
2In a decision dated August 30, 2001 the Board directed this matter be scheduled with Board File No’s. 0759-01-U, 0760-01-U and 1021-01-U.
3In that decision the Board directed the responding party to include in its response submissions on its position with respect to the applicants’ production request.
4By letter dated September 5, 2001, to counsel for the applicant, counsel for the responding party has asked for production of a number of particulars.
5In a letter dated September 5, 2001 to the Board counsel for the applicant has asked for an order to produce the requested particulars.
6In another letter dated September 5 2001 to the Board counsel for the responding party has indicated that he has asked counsel for the applicant to deliver to him copies of the pleadings in Board File No’s. 0759-01-U; 0760-01-U and 1021-01-U. It seems to be alleged that these pleadings have not been served on the responding party.
7In both letters dated September 5, 2001 to the Board, counsel for the responding party has asked that an extension be granted “until ten days after” counsel for the responding party has received the particulars requested and the pleadings requested
8A hearing in this matter is scheduled to commence September 28, 2001.
9In the circumstances the Board directs:
the responding party to produce to the applicant on or before September 12, 2001 those particulars and documents requested in counsel for the applicant’s letter of August 23 2001.
the applicant to produce to the responding party on or before September 12 2001 those particulars and documents requested in counsel for the applicant’s letter of September 5, 2001.
10The Board further directs the respective parties to advise the Board and the other party by September 12, 2001 those particulars and documents which have not been produced and the reasons why they have not been produced.
11If there is any dispute regarding the particulars and documents sought to be produced and/or the scope of production the parties should be prepared to make submissions before the panel hearing this matter on September 28, 2001.
12The Board also directs the applicant, if it has not already done so, to deliver the pleadings in Board File No’s. 0759-01-U; 0760-01-U and 1021-01-U to counsel for the responding party by September 10, 2001.
13An extension is granted until September 20, 2001 to the responding party to file a response in this matter.
