DECISION OF THE BOARD; October 18, 2001
This is an application for certification in the construction industry. A representation vote was held on September 7, 2001 and the ballot box was sealed. There is a dispute between the parties as to whether the responding party is the employer of the individuals who voted. The responding party says they are employed by Pit-On Construction Company Limited. The Board hereby directs that Pit-On Construction Company Limited be given notice of this proceeding and provided with copies of the application, response and submissions.
The responding party filed submissions with respect to the status of the individuals who voted on October 11, 2001 which is after the date on which such submissions were to have been filed with the Board. However, the Board can perceive no prejudice in exercising its discretion to extend the time limits for filing the submissions in the circumstances of this case. The responding party has consistently taken the position since it filed its response that it is not the employer of the individuals who voted. The Board will therefore accept the responding party’s submissions filed on October 11, 2001.
This matter will be referred to the Registrar to schedule a hearing.
