DECISION OF THE BOARD; July 23, 2001
The Board (differently constituted), by decision in this matter dated July 19, 2001 indicated that the applicant had described itself as “The International Union of Painters and Allied Trades, District Council 46 (Local Union 1891)” in the title of proceedings, but in the body of the application had indicated that it was not a council of trade unions. The Board also notes that the applicant stated at paragraph 1 of the application that the correct name of the applicant is “International Union of Painters and Allied Trades, Local Union 1891.” The Board, in that decision, treated the application as having been filed by the International Union of Painters and Allied Trades, Local Union 1891 and noted that the correct name of the applicant was a matter that needed to be clarified by the applicant.
Counsel for the International Union of Painters and Allied Trades, District Council 46 and Local 1891 advised the Board that the correct name of the applicant is the International Union of Painters and Allied Trades, Local 1891. Counsel also indicated that the applicant had made a mistake in good faith in adding the name of District Council 46 to the application. The Board, at the request of the applicant to exercise its discretion under section 112 of the Labour Relations Act, 1995, S.O. 1995, c. 1, as am. (which allows the Board to correct the name of a party when a mistake has been made in good faith when a party has been incorrectly named) hereby amends the name of the applicant to International Union of Painters and Allied Trades, Local 1891.
