DECISION OF THE BOARD; May 4, 2001
1By decision dated March 23, 2001, a differently constituted panel of the Board directed the applicant to file submissions with respect to the objections of the responding party (“the union”) and the intervenor to the request of the applicant to file an amended application. The applicant has complied with the Board’s direction. Although the union was not directed to file submissions in reply, counsel for the union filed correspondence with the Board, dated April 24, 2001 concerning a request for particulars of certain of the allegations contained in the applicant’s amended application. Counsel for the applicant responded by letter dated April 30, 2001.
2Having reviewed all the submissions, I am satisfied that this is an appropriate case to permit the filing of the amended application, dated March 8, 2001, and I so order.
3I am also of the view that the union’s request for certain particulars is warranted at this stage. Accordingly, the applicant is directed to file and deliver written submissions containing the following:
(i) the names of the two foremen referred to in paragraph 24 of the amended application;
(ii) the name of the female co-worker referred to in paragraph 25 of the amended application;
(iii) the name of the individual referred to in paragraph 27 of the amended application, who the applicant alleges attempted to injure him;
(iv) the names of the individual co-workers referred to in paragraph 28 of the amended application, who the applicant recalls allegedly refused to assist him.
4Following delivery of the particulars herein directed, the union is directed to file its response within the time period set out in the Board’s Rules of Procedure. To the extent the intervenor wishes to file an amended response, it must do so within the same time period, following delivery of the applicant’s particulars.
