DECISION OF THE BOARD; November 22, 2001
1This is an application for a review of a decision of an employment standards officer pursuant to section 68 of the Employment Standards Act, R.S.O. 1990 ch. E-14 ("the Act") filed by the applicant employer. The appropriate monies were paid to the Director in trust. On August 29, 2001 counsel for the applicant wrote to the Board advising that the applicant was “presently in bankruptcy proceedings” and that he had no instructions from the receiver or trustee.
2The hearing was set for 9:30 a.m. on November 22, 2001. The applicant did not appear. At 10:05 a.m. the hearing was commenced. As the applicant called no evidence, the application is dismissed.
3I direct the Director to pay to the applicant from the monies held in trust, being $7,880.21, plus any interest that the Director determines, and to pay to the Consolidated Revenue Fund the statutory administration costs of $788.02.
