DECISION OF THE BOARD; November 6, 2001
1Pursuant to the Board’s direction of October 16, 2001 (inadvertently dated October 16, 2000), the Board is in receipt of submissions from counsel for the applicant dated October 31, 2001.
2Having regard to the material contained in the application and the submissions dated October 31, 2001, the Board declines the responding party’s request that this matter be dismissed without a hearing or consultation pursuant to section 46 of the Board’s Rules of Procedure. This ruling is not intended in any way to impede the ability of the vice-chair assigned to this matter to dismiss all or part of this matter at any time for any reason. The responding party is free to raise any objections it has with respect to the applicant’s ability to pursue all or part of this complaint with the vice-chair at the consultation.
3Having regard to the Board’s ruling, the responding party is directed to file its response no later than November 20, 2001. This matter is referred to the Labour Relations Officer for the purposes of holding a meeting with the parties.
