Hamilton Professional Fire Fighters Association v. The City of Hamilton
3115-00-PS Hamilton Professional Fire Fighters Association, Applicant v. The City of Hamilton, Responding Party.
BEFORE: Laura Trachuk, Vice-Chair.
DECISION OF THE BOARD; May 2, 2001
1In the Board’s decision of April 12, 2001 it advised that it would remain seized of the issue of the volunteers in the fire department until April 27, 2001. The Board indicated that if it did not receive any request from the parties to deal with the matter on or before that date this application would be terminated. The Board has not received any correspondence from the parties about that issue. The Board has, however, received correspondence on behalf of 23 volunteer firefighters asking that the Board remain seized in case their status becomes an issue in the future.
2The volunteer firefighters are not a party to this application. They might have an interest in the matter if the parties were asking the Board to make a declaration about their status. However, the parties are not asking the Board to make such a declaration. By their silence the parties have indicated that there is no issue with respect to the volunteers which must be determined in this application. The issue that was in dispute between the parties was decided in the Board’s decision of April, 12, 2001. This application is therefore terminated.
