DECISION OF THE BOARD; October 15, 2001
This matter was terminated on September 17, 2001 for failure to comply with the Board’s Rules when filing an application under the Employment Standards Act (the “Act”). The Registrar of the Board advised the applicant that she is required to file her application pursuant to the Rules of Procedure and file the application on the correct form – Form A-69. Copies of the relevant documents were sent to the applicant together with an information bulletin. The Registrar’s letter was dated August 10, 2001. The applicant was directed to file her application on the correct form and pursuant to the Rules within 10 working days of August 10, 2001. The deadline for resubmitting the application was August 24, 2001.
The Board’s decision terminating this matter was issued on September 17, 2001 approximately three weeks after the deadline of August 24, 2001. As of today’s date the Board has not received a Form A-69 application from the applicant.
On September 20, 2001 the applicant, Marija Babic, wrote to the Board requesting that the Board reopen her claim. Ms. Babic included copies of a number of documents relating to her application. Ms. Babic states that she filled out the forms and sent them to the Board pursuant to the Registrar’s request of August 10, 2001. However, none of the documents attached to the September 20 letter include a copy of the Form A-69, the form required to make this application pursuant to the Rules of Procedure. The documents attached to the applicant’s September 20 letter are copies of correspondence either sent or received by the applicant.
Assuming the September 20, 2001 letter is a request for reconsideration of the Board’s decision terminating this matter, there are no supporting documents filed with the September 20 letter that would cause the Board to reconsider its decision.
DISPOSITION
- This request for reconsideration is dismissed.
