Decision of the Board
1This is an application pursuant to section 96 of the Labour Relations Act, 1995 alleging violation of section 74.
2The responding party union submits that the complaint filed by the applicant is outside the jurisdiction of the Board because it pertains to a Federal undertaking, and should accordingly be dismissed. It asserts that the relevant collective agreement covers a national bargaining unit. The responding party has filed a copy of the collective agreement between Purolator and the Canada Council of Teamsters expiring December 31, 2003. The agreement covers employees in several provinces, including Ontario.
3The applicant is directed to reply to the union’s submissions in respect of the Board’s lack of jurisdiction. The reply shall be filed with the Board (with a copy to the union and Purolator Courier) by no later than July 27, 2001. If a reply is not received by that date, the application will be terminated. If a reply is received, the Board will consider the matter further.
