DECISION OF THE BOARD; November 14, 2001
1. The Officer’s letter refusing to issue an order to pay in the appropriate favour is dated July 31, 2001. This application was filed with the Board on October 12, 2001, more than 45 days after the Officer’s letter. This application was thus not filed within the time limits set out in the Employment Standards Act and is untimely.
2. By letter dated October 25, 2001 the applicant was advised that the application was not timely and instructed, if he wished to request an extension of time for the filing of the application to file submissions with the Board within 10 days. No such submissions have been received.
3. Having regard to the foregoing, this matter dismissed on the basis that it is untimely.
