DECISION OF THE BOARD; October 9, 2001
This is an application for reconsideration of a decision issued on August 30, 2001 in this matter.
The applicant alleges that there is an error in law apparent on the face of the decision. The applicant seeks a ruling whether the Board lacked jurisdiction to determine the issue, or whether the applicant failed to establish a prima facie case.
The Board sees no reason to reconsider its decision of August 30, 2001. In paragraph 10 the Board, for reasons set out in such decision, found that the pleadings did not raise a prima facie issue that the WSIB had breached section 72 of the Labour Relations Act, 1995, S.O. 1995, c.1, as amended (the “Act”).
