This is an application filed under section 96 of the Labour Relations Act, 1995, S.O. 1995, c.1 ('the Act') alleging a violation of section 76.
The applicant’s position is that it is not bound to the collective agreement that is the subject matter of these proceedings; the responding party trade unions asserts that the applicant is so bound.
On the date and time scheduled for hearing the parties appeared before me. After hearing initial submissions, the applicant advised that it wished to withdraw the application.
