Ontario Labour Relations Board
0050-01-R Labourers’ International Union of North America, Applicant v. Somerlyn Trim & Doors Inc., Responding Party v. Carpenters and Allied Workers Local 27, United Brotherhood of Carpenters and Joiners of America, Intervenor.
BEFORE: D.L. Gee, Vice‑Chair.
APPEARANCES: John Moszynski, Tony Ianuzzi and Henry Pereira for the applicant; Jennifer Kerr, Peter Gallo and Paula Martins for the responding party; Peter Shklanka, Norman L. Jesin and Fernando Lima for the intervenor.
DECISION OF THE BOARD; July 6, 2001
1This matter was listed for hearing on July 4, 2001. At the hearing the parties agreed to count nine of the 11 ballots cast. All nine of the ballots counted were cast in favour of Carpenters and Allied Workers Local 27, United Brotherhood of Carpenters and Joiners of America such that the remaining two ballots are not numerically relevant.
2Having regard to the foregoing, it is apparent that not more than fifty per cent of the ballots cast by employees in the bargaining unit were cast in favour of the applicant.
3The application is therefore dismissed.
4The Registrar will destroy the ballots cast in the representation vote taken in this matter following the expiration of 30 days from the date of this decision unless a statement requesting that the ballots should not be destroyed is received by the Board from one of the parties before the expiration of such 30 day period.
5The responding party is directed to post copies of this decision immediately, adjacent to the "Notice of Vote and of Meeting" posted previously. These copies must remain posted for a period of 30 days.
