DECISION OF THE BOARD; June 5, 2001
1This matter is an application for review filed under section 68 of the Employment Standards Act, R.S.O. 1990, c.E-14, as amended (the "Act"). This application was scheduled to be heard commencing at 9:30 a.m. on Tuesday, June 5, 2001.
2At the commencement of the hearing, no one was in attendance on behalf of the applicant. The Board waited until 10:00 a.m. in case the applicant had been inadvertently delayed. At 10:00 a.m. the applicant was still not in attendance and accordingly the hearing proceeded in the absence of the applicant.
3Having regard to the fact that the applicant did not attend at the hearing of this matter, this application is hereby dismissed.
4The Director of Employment Standards is hereby directed to pay the sum of $1,693.12 out to the claimant, Flutra Mujku plus any interest accumulated thereon.
