DECISION OF THE BOARD
1The Board by decision in this matter dated May 23, 2001 directed the responding party to file any representations it wished to make with respect to the applicant’s request to schedule this matter for hearing at the same time as a number of applications involving both parties that have already been scheduled for hearing on June 18, 2001.
2The responding party filed its Request for a Hearing and Notice of Intent to Defend (Form A-87) on May 25, 2001. In submissions from its counsel dated May 24, 2001, the responding party recognizes that the same issues are raised in those other applications, but suggests that the Board hold this matter in abeyance until after the parties have met to discuss how this arbitration should proceed, in view of the per diem fees that would be payable should this matter proceed at the same time as those other applications. That meeting was to have occurred on May 28, 2001. The Board has not been advised of any resolution of the procedural matter as of this date.
3Having regard to the request of the applicant and the acknowledgement of the responding party that the issues in this matter overlap with the issues raised in other proceedings between these parties that are already scheduled for hearing on June 18, 2001, this matter is referred to the Registrar to be listed for hearing with the applications in Board File Nos. 3582-00-R, 3746-00-U, 3747-00-U, 3748-00-U and 0159-01-G. Whether this matter will be consolidated with the others and how all of these matters will proceed at that time is something that the panel of the Board assigned to hear these matters on that date will determine at that time.
4This panel of the Board is not seized with this matter.
