DECISION OF THE BOARD; July 9, 2001
1These are related matters in which a number of Board decisions have issued. The parties disagree on the order of proceeding. There are a number of challenges to the list in the certification application. The section 96 application alleges the grievors were discharged in violation of the Labour Relations Act, 1995 (the “Act”).
2The applicant states it will have five witnesses with respect to the section 96 application. There are 17 individuals involved in the status dispute issue.
3Having reviewed the materials filed and the submissions made by the parties the Board directs these matters proceed as follows. Both matters will be listed for hearing. The section 96 application will proceed first. If any of the witnesses giving evidence in the section 96 application are also individuals whose status is challenged, the parties are directed to be prepared to ask any questions relevant to the status issue. This will avoid recalling witnesses to testify with respect to the status issue.
4These matters will continue on July 17, 18, 19, 24, 25, 26 and 27, 2001 and September 26 and 27, 2001 at 9:30 a.m. at the Board’s premises located at 505 University Avenue 2nd Floor, Toronto, Ontario.
