DECISION OF THE BOARD; November 2, 2001
Decision
1These are four referrals of a grievance to arbitration under section 133 of the Labour Relations Act, 1995 (the “Act”). They were filed with an application under section 1(4) of the Act. In a decision dated August 28, 2001 the Board found that all of the responding parties were under common control and direction within the meaning of the Act.
2Having regard to that finding and the circumstances of these referrals, the Board hereby amends the style of cause in Board File No. 0270-00-G to add all the responding parties who had previously been the subject of separate referral applications and who were the subject of the section 1(4) determination. Board File Nos. 0269-00-G, 0271-00-G and 0272-00-G are hereby terminated. The addressees on these terminated files should be added to the list of addresses in Board File No. 0270-00-R.
3At the date and time scheduled for hearing no one appeared for any of the responding parties. The Board determined that the notice of hearing had been returned as undelivered for one of the responding parties, Tanya Ruth Ann Genest c.o.b. as Westboro Construction. Counsel for the applicant advised that he had recently learned of a new address for that responding party and would advise the Registrar of that information. By letter dated November 1, 2001, counsel has advised that the new address is:

4As the Board could not be certain that notice of hearing was properly provided to one of the parties in these referrals, the Board adjourned the hearing to December 7, 2001.
