This is an employer appeal of an Order to Pay issued by an Employment Standards Officer.
A hearing was scheduled in this matter for 9:30 a.m. on August 9, 2001 at the Board’s offices in Toronto.
A review of the file suggests that a notice of hearing was sent to all parties.
At the appointed time for the hearing, neither the applicant nor the responding party Conway Crick was in attendance. Accordingly, the Board stood down the hearing until 10:00 a.m. At 10:00 a.m. the applicant was not in attendance. Therefore, the Board orally dismissed the application. This decision confirms that oral decision.
Disposition
The application is dismissed.
The Board orders that the money held in trust by the director as wages be paid to the employee. The administration fee thereon is to be retained by the Government of Ontario Consolidated Revenue Fund.
