DECISION OF THE BOARD; September 6, 2001
1These are related matters. The parties have agreed to adjourn the hearings scheduled in these matters and have further agreed to deal with the application under section 69/1(4) of the Labour Relations Act, 1995 (the “Act”), Board File No. 0792-01-R, prior to the certification application in Board File No. 0649-01-R.
2Having regard to the agreement of the parties the certification application is adjourned pending the disposition of the related employer/sale of a business application in Board File No. 0792-01-R.
3The applicant in its letter of August 22, 2001 asks for a Board Order with respect to pre-hearing production of relevant documents pursuant to section 1(5) and 69(13) of the Act. The correspondence to the Board indicates that Counsel for the responding parties received a copy of the August 22, 2001 letter.
4The letter of August 22, 2001 sets out the documents and information the applicant is seeking. Items 1 to 12 in that letter appear to be arguable relevant to the issues raised in the section 69/1(4) application.
5The responding parties are directed to either provide the documents requested in items 1 to 12 or make them available for inspection to the applicant on or before Friday, September 21, 2001. If the responding parties object to producing any documents or to make them available for inspection by the applicant, they are directed to list such documents and the basis of their objection.
6This matter is referred to the Registrar to reschedule hearing dates in Board File 0792-01-R after September 28, 2001.
