Decision of the Board; July 12, 2001
1This is an application for a review of a decision of an employment standards officer pursuant to section 68 of the Employment Standards Act, R.S.O. 1990 ch. E-14 ("the Act"). The original application was apparently filed in a timely fashion, including the monies required to be paid under section 68(7), but on the wrong form. The applicant was given 10 days to make application on the correct form. It did not do so until July 6, 2001, more than 10 days from the date of the Registrar's letter but within 10 days of receipt of it by the responding party.
2In the circumstances outlined in the applicant's letter of July 4, 2001, the Board extends the time for the filing of the application to July 6, 2001, the date it was actually received by the Board. The Registrar is directed to process the file in the usual fashion.
3The style of cause as set out in the application is amended to reflect the proper parties in this application. The applicants are the corporations named in the Order to Pay. The employee responding party is Joe Cacciola. Although this application was also filed as an appeal by a Director, there is no Order to Pay against any individual as director enclosed with the application.
