DECISION OF THE BOARD; August 15, 2001
1This is an application under section 96 of the Labour Relations Act, 1995 (“the Act”).
2The Board is in receipt of correspondence dated August 15, 2001 from the responding party in which it objects to the allegations contained in the applicant’s letter dated August 14, 2001 purporting to provide further particulars of its application, and seeks “that the Board make an immediate, pre-hearing ruling that the Union shall not be permitted to rely upon any of the particulars filed in its letter of August 14, 2001”.
3The hearing in this matter is scheduled to commence on Monday, August 20, 2001.
4The applicant is directed to file written submissions with the Board in response to the responding party’s letter of August 15, 2001 by no later than August 17, 2001. Any outstanding issue with respect to the applicant’s ability to rely on the allegations contained in its letter of August 14, 2001 may be dealt with by the Board at the hearing, if necessary.
