DECISION OF THE BOARD
1This is an application under section 96 of the Labour Relations Act, 1995, (the “Act”) in which the applicant alleges that the responding party violated section 57(1) of the Act.
2In its response, the responding party requests that this application be dismissed for failing to disclose a prima facie case of a violation of section 57(1) of the Act. More specifically, the responding party states in essence that the applicant’s complaint appears to relate to an alleged violation of the agreement between the parties and therefore is the subject matter of a grievance and not of a complaint under section 96 of the Act.
3The applicant is directed to file submissions with the Board (copied to the responding party) in response to the responding party’s request that the application be dismissed for failing to disclose a prima facie case within five (5) days from the date of this decision. In the event that no submissions are received by the Board by that date, this application will be deemed to be dismissed.
