DECISION OF THE BOARD; August 16, 2001
1. This is an application for certification. It was filed on April 12, 2001.
2. By decision dated April 19, 2001, the Board permitted the applicant to transfer membership evidence from a previous certification application filed on April 4, 2001 (Board File No. 0048-01-R) and withdrawn with leave of the Board and without conditions pursuant to Board decision dated April 19, 2001.
3. In its April 19, 2001 decision relating to the instant application, the Board directed a representation vote and ordered that the ballot box be sealed and the ballots not counted until the Board so ordered or the parties agreed. Those ballots have not been counted.
4. By letter dated August 14, 2001, the applicant seeks leave of the Board to withdraw the instant application.
5. The application is withdrawn with leave of the Board.
6. The Board directs the parties’ and the employees’ attention to section 7(9.1) of the Act. Should an application for certification be filed within one year of the date of this decision, the effect, if any, of this decision and section 7(9.1) of the Act on that subsequent application may be determined, if necessary, at that time.
