DECISION OF THE BOARD; April 30, 2001
1This is an application under section 68 of the Employment Standards Act, R.S.O. 1990, c. E. 14, as amended for review of Order to Pay No. D 04621 issued pursuant to section 58.22 of the Act by Employment Standards Officer P. Harris Bernard dated February 1, 2000. A hearing was held on November 30, 2000 and a decision was issued on December 8, 2000.
2It has come to the attention of the Board by way of a letter dated March 29, 2001 that the monies ordered to be paid in this matter have not been received. The Board hereby amends its decision of December 8, 2000 in the following two regards. First, the monies that are ordered to be paid in paragraph 8 of that decision are now payable to the Director of Employment Standards, in trust. Second, the one hundred dollar letter of credit referred to in paragraph ten of the decision shall not be returned to Mr. Lockwood until he has satisfied his obligations to the Director of Employment Standards, in trust.
