1This is an employee appeal under section 68 of the Employment Standards Act (the “Act”) requesting review of Employment Standard Officer’s decision dated March 5, 2001.
2The March 5, 2001 letter was sent to counsel for the applicant advising the applicant that the Employment Standards Officer would not be taking any action in this matter for the reasons set out in the letter.
3Counsel for the applicant filed the instant appeal on July 26, 2001. The deadline for making this appeal under section 68(3) is within 45 days of the date of the officer’s decision.
4There are no circumstances in this application that would cause the Board to extend the time for filing beyond the 45 days.
DISPOSITION
5This application is dismissed as being untimely pursuant to section 68 of the Act.
